Terms of Use

for the use of the Salonado platform by customers. For salons, the Terms and Conditions for Salon Partners apply in addition.

§ 1 Scope of Application and Provider

(1) These Terms of Use govern the use of the Salonado platform, available at salonado.com and via any mobile applications (apps) of Salonado (together hereinafter the "Platform"), by end customers (hereinafter "Users"). When you use the apps, the terms of the respective app store may apply in addition.

(2) The Platform is operated by Salonado, Viktor Töws, Röpkestraße 61, 40235 Düsseldorf, Germany (hereinafter "Salonado", "we"). You can reach us via our contact form.

§ 2 Services Provided by Salonado

(1) Salonado is an intermediary platform. We enable Users to find hairdressing, beauty and comparable services offered by the salons listed on the Platform (hereinafter "Salons") and to book appointments online.

(2) Contracts for the booked services are concluded exclusively between the User and the respective Salon. Salonado does not become a party to the treatment contract, does not provide the booked services itself and owes neither their performance nor their quality.

(3) The content of the Salon profiles (in particular services, prices, opening hours, images and descriptions) is provided by the respective Salons. Salonado does not warrant its accuracy, completeness or currency.

(4) Use of the Platform is free of charge for Users. You only pay the price of the service booked with the Salon; Salonado does not charge Users any booking or service fees.

§ 3 Registration, User Account and Guest Booking

(1) Appointments can be booked without registration as a guest or with a free user account. Registration is possible using an e-mail address or an existing Google account.

(2) Use of the Platform requires that the User is of legal age or, with the consent of their legal representatives, is entitled to validly conclude contracts for the booked services.

(3) You must provide truthful and complete information when registering and booking. Access credentials must be kept confidential; passing them on to third parties is not permitted. The User shall notify us without undue delay via our contact form if there are indications that their account is being misused.

(4) The User may delete their account at any time. Statutory retention obligations remain unaffected.

§ 4 Booking and Conclusion of Contract with the Salon

(1) On the Platform, the User selects a Salon, a service, an appointment and, where applicable, a staff member, and completes the booking using the button provided for this purpose.

(2) Upon completion of the booking, the contract for the selected service is concluded between the User and the Salon. The User receives a booking confirmation by e-mail.

(3) The prices displayed are set by the Salons and are final prices inclusive of statutory value added tax, unless stated otherwise.

§ 5 Payment

(1) Depending on the Salon, payment is made on site at the Salon or online as part of the booking. The available payment options are displayed during the booking process.

(2) Online payments are processed via the payment service provider Stripe. The payment amount is collected directly on behalf of the respective Salon; the payment discharges your payment obligation towards the Salon. Salonado itself does not provide any payment services. In addition, the information in our privacy policy applies.

(3) If an online payment that has been initiated is not completed, no booking is concluded; the reserved appointment is released again.

§ 6 Cancellation, Rebooking and No-Show

(1) Booked appointments can be cancelled or rescheduled via the Platform or via the functions included in the booking confirmation.

(2) Whether and until when a free-of-charge cancellation or rebooking is possible is governed by the conditions of the respective Salon, which are communicated during the booking process or in the booking confirmation.

(3) If the User fails to attend a booked appointment without cancelling, the Salon may have claims arising from the contract concluded between the User and the Salon. Repeated unexcused no-shows may lead to the suspension of the user account in accordance with § 12.

§ 7 Right of Withdrawal

(1) For contracts for services related to leisure activities and for services to be provided on a specific date, there is no statutory right of withdrawal pursuant to § 312g(2) no. 9 BGB (German Civil Code). A booked appointment with a Salon can therefore not be withdrawn under the provisions on distance contracts. The cancellation options under § 6 remain unaffected.

(2) The contract for the use of the Platform itself is free of charge for the User and can be terminated at any time by deleting the account.

§ 8 Reviews and Reporting of Content

(1) Users may review Salons. Reviews must be based on the User's own, actual experience with the reviewed Salon and must be worded objectively.

(2) The following in particular are not permitted: untrue statements of fact, insults and abusive criticism, content that infringes the rights of third parties, reviews written on behalf of others or for remuneration, and reviews of your own or a competing business.

(3) By submitting a review, the User grants Salonado the right to publish the review on the Platform without limitation in time or territory. There is no entitlement to publication. Salonado may review and remove reviews if there are specific indications of a violation of these terms or of statutory provisions. The opinions expressed are those of the respective authors and not those of Salonado.

(4) Anyone who considers content published on the Platform to be unlawful (e.g. an insulting or untrue review) may report this to us via our contact form, stating the content concerned and the reasons. We review every report and remove or block unlawful content.

§ 9 Prohibited Use

The following in particular are prohibited: bookings without a serious intention to be bound (sham and test bookings), providing third-party or false data, automated extraction of Platform data (scraping), interference with the technical infrastructure, introducing viruses or other malicious software, attempts to gain unauthorised access to our systems, and any use that violates applicable law or the rights of third parties.

§ 10 Intellectual Property

(1) The Platform and its content (in particular texts, design, logos, software and databases, with the exception of content posted by Users and Salons) are protected by copyright and trademark law. The name "Salonado" and associated signs may not be used without our prior consent.

(2) Users may use the Platform and its content exclusively for private, non-commercial purposes within the scope of the intended functions. Any reproduction, distribution or making available to the public beyond this requires our prior consent in text form.

§ 11 Availability, Third-Party Content and Liability

(1) Salonado endeavours to provide the Platform with as few interruptions as possible. There is no entitlement to constant availability; maintenance work, further development and technical faults may lead to temporary restrictions.

(2) Where the Platform contains links to external third-party websites, the respective providers are responsible for their content; if we become aware of legal infringements, we will remove the links concerned.

(3) Salonado is liable without limitation for intent and gross negligence, for damage resulting from injury to life, body or health, and under the German Product Liability Act. In the event of a slightly negligent breach of material contractual obligations (obligations whose fulfilment is essential to the proper performance of the contract in the first place and on whose observance the User may regularly rely), liability is limited to the foreseeable damage typical for this type of contract. In all other respects, liability is excluded.

(4) The respective Salon is solely liable for the performance, quality and freedom from defects of the services offered by the Salons.

§ 12 Suspension and Termination

(1) Salonado may temporarily suspend or permanently close user accounts if the User seriously or repeatedly violates these Terms of Use or if there is reasonable suspicion that an account is being misused. The User's interests are given due consideration in this decision.

(2) The User's right to delete their account at any time remains unaffected.

§ 13 Data Protection

Information on the processing of personal data can be found in our privacy policy.

§ 14 Changes to These Terms of Use

Salonado may amend these Terms of Use with effect for the future where there is a valid reason for doing so (e.g. changes in the law, new features) and the change is reasonable for the User. Registered Users will be informed of changes in text form at least four weeks before they take effect. If the User does not object within this period or continues to use the Platform after the changes take effect, the amended terms are deemed accepted; this will be pointed out separately in the notification.

§ 15 Contact and Consumer Dispute Resolution

(1) Please address questions and complaints regarding the Platform to us via our contact form. We endeavour to respond to enquiries promptly.

(2) Salonado is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board within the meaning of the VSBG (German Consumer Dispute Resolution Act).

§ 16 Final Provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. With respect to consumers, this choice of law applies only to the extent that it does not deprive them of the protection of mandatory provisions of the law of the state in which they have their habitual residence.

(2) Should individual provisions of these Terms of Use be or become invalid, the validity of the remaining provisions remains unaffected.
